Kuwait Labour Law Gratuity Explained (2026)

Everything you need to know about Kuwait end-of-service benefits — Articles 51, 53, and 70 — with formulas, worked examples, and how to claim your rights.

What is End-of-Service Gratuity in Kuwait?

End-of-service gratuity (also called indemnity or EOS benefit) is a mandatory financial payment that every private-sector employer in Kuwait must pay to an employee when their employment ends. It is governed by Kuwait Labour Law No. 6 of 2010.

How Gratuity is Calculated — The Article 51 Formula

Article 51 of Kuwait Labour Law No. 6/2010 is the core gratuity calculation rule. It uses a two-tier rate based on years of service:

Daily Rate = Basic Monthly Salary ÷ 26

First 5 Years: 15 days × Daily Rate × Years (up to 5)
After 5 Years: 30 days × Daily Rate × Years (beyond 5)

Maximum Cap: 18 months' basic salary

Worked Example — 7 Years Service, 500 KWD Salary

📋 Example: Ahmed, 7 years service, 500 KWD basic salary, terminated by employer

Daily Rate = 500 ÷ 26 = 19.231 KWD

First 5 years: 5 × 15 × 19.231 = 1,442.31 KWD

Years 6 & 7 (2 years): 2 × 30 × 19.231 = 1,153.85 KWD

18-month cap check: 500 × 18 = 9,000 KWD (not exceeded)

✅ Total Gratuity = 1,442.31 + 1,153.85 = 2,596.15 KWD

⚠️ The 18-month cap means even if you work 30+ years, the maximum gratuity is 18 × your monthly basic salary. However, Article 70 unused leave payout is added on TOP of this cap.

Resignation Deductions — Article 53 Rules

Article 53 applies when an employee voluntarily resigns. The deduction scale is based on total years of service at time of resignation:

📋 Example: Maria, resigned after 4 years, 400 KWD basic salary

Daily Rate = 400 ÷ 26 = 15.385 KWD

Base Gratuity (Art. 51) = 4 × 15 × 15.385 = 923.08 KWD

Resignation at 4 years = 50% entitlement

✅ Final Gratuity = 923.08 × 50% = 461.54 KWD

Unused Annual Leave Payout — Article 70

Article 70 gives every employee the right to receive cash payment for annual leave days they earned but did not take. This applies regardless of whether you resigned or were terminated.

Leave Payout = Unused Leave Days × (Basic Monthly Salary ÷ 26)

📋 Example: Ravi, 18 unused leave days, 350 KWD basic salary

Daily Rate = 350 ÷ 26 = 13.462 KWD

✅ Leave Payout = 18 × 13.462 = 242.31 KWD (added on top of gratuity)

✅ Article 70 leave payout is NOT subject to the 18-month cap. It is always added on top of your gratuity total, making it a very important addition for long-service employees.

Collect all documents: employment contract, salary slips, resignation/termination letter, leave records.

Send a formal written request to your employer or HR department via email (keep a copy of everything).

If employer does not respond within 7 days, file a complaint at Kuwait Public Authority for Manpower (PAM): pam.gov.kw. Bring all documents.

PAM will summon the employer for mediation — most cases are resolved at this stage without needing court.
