Common Dispute: 'You Resigned' vs 'I Was Forced Out'
A very common situation: employer records resignation on paper, but the employee was verbally told their services are no longer needed, or conditions were made so difficult that resignation was the only option.
⚠️ Never sign a resignation letter if you were actually terminated by your employer. Signing resignation waives your right to 100% termination gratuity.

Termination for Misconduct (Article 41)
If the employer terminates for proven misconduct under Article 41 of Kuwait Labour Law, they may be entitled to withhold gratuity. However, the bar for 'misconduct' is very high under Kuwait law and must be properly documented and proven.
Mutual Agreement / Contract Expiry
For limited-period contract workers: if the contract expires and is not renewed, this is typically treated as termination and you receive 100% gratuity. If you mutually agree to end the contract early, different rules may apply — consult PAM.
Unused Leave (Article 70) — Same for Both
