How to Calculate Resignation Indemnity in Kuwait

1. Legal Basis: Article 51 & Article 53
Under Kuwait Labor Law No. 6/2010, the end-of-service benefit (indemnity) is a right for all private-sector employees. However, the law distinguishes between whether an employee is terminated by the employer or resigns voluntarily. While a terminated worker receives 100% of their accumulated benefits, a resigned worker's payout is subject to a sliding reduction scale defined under Article 53.

To calculate your final payout when resigning, you must follow a two-step calculation process: first, find the Base Indemnity using the standard labor law formula; second, apply the reduction percentage according to your service years.
Step 1: Calculate Daily Salary Rate
Under Kuwait Labor Law, a work month is legally defined as 26 working days. To find your daily rate, divide your basic salary by 26.
Step 2: Calculate Base Indemnity
- For the first 5 years of service: 15 days of salary per year.
- For any years beyond the first 5: 30 days of salary per year.
3. Step-by-Step Calculation Examples
📋 Example A: Resigning after 4 years of service (Basic Salary: 300 KWD)
1. Daily Rate: 300 KWD ÷ 26 = 11.538 KWD
2. Base Indemnity Accrued: 4 years × 15 days per year = 60 days of salary.
60 days × 11.538 KWD = 692.28 KWD
3. Resignation Adjustment (3 to 5 years = 50% payout):
692.28 KWD × 50% = 346.14 KWD
📋 Example B: Resigning after 8 years of service (Basic Salary: 450 KWD)
1. Daily Rate: 450 KWD ÷ 26 = 17.308 KWD
2. Base Indemnity Accrued (First 5 years): 5 years × 15 days = 75 days.

Total Accrued Days = 75 + 90 = 165 days.
165 days × 17.308 KWD = 2,855.82 KWD base indemnity.
4. Resignation Adjustment (5 to 10 years = 66.6% payout / lose 1/3):
2,855.82 KWD × 0.666 = 1,901.98 KWD
4. Important Rules & Limits
- Maximum Payout Cap: Under Article 51, the total end-of-service indemnity must not exceed 18 months of salary. This cap applies to the base indemnity before resignation deductions are made.
- Leave Encashment (Article 70): Any unused annual leave payout is calculated at your full wage rate (Salary ÷ 26 × unused days) and is NOT subject to the Article 53 resignation scale. You will receive 100% of your leave payout regardless of your years of service.
